Can I apply for the Second Chance Act if I have debts with the Tax Agency?
The Second Chance Act is a legal mechanism that allows individuals, including self-employed workers, to cancel their debts and improve their financial situation. This law, regulated in Royal Decree-Law 1/2015 and Royal Legislative Decree 1/2020, was recently reformed by Law 16/2022, introducing significant changes in its application, particularly regarding debts with the Tax Agency. ✍️
What is the Second Chance Act?
The Second Chance Act is designed to offer a way out for those who, due to adverse circumstances, cannot meet their debt obligations. This mechanism allows for debt discharge, which means that under certain conditions, the debtor can be freed from their financial obligations and start over.
How does the Second Chance Act affect debts with the Tax Agency?
One of the most relevant aspects of the 2022 reform is the possibility of discharging up to 10,000 euros of debt with the Tax Agency. This discharge is applied as follows:
The first 5,000 euros of debt are entirely canceled.
From 5,000 to 15,000 euros, 50% of the debt is eliminated, while the remaining 50% is amortized through a payment plan.
Debts exceeding 15,000 euros are also amortized through a payment plan, along with half of the debt between the first 5,000 and 15,000 euros.
Requirements to apply for the Second Chance Act
To benefit from the Second Chance Act and cancel debts with the Tax Agency, certain requirements must be met:
Be a physical person: This includes both individuals and self-employed workers. Companies, as legal entities, cannot apply for this act.
Have debts with more than one creditor: Having debts only with the Tax Agency is insufficient; there must be at least one other creditor, which can be Social Security or any private entity (banks, suppliers, etc.).
Be in a current or imminent insolvency situation: The debtor must be unable to meet financial obligations regularly and on time.
Be a good-faith debtor: The law sets certain criteria to determine the debtor’s good faith, such as not being declared guilty in a bankruptcy or not committing certain crimes in the last ten years.
Procedure to apply for the Second Chance Act
The process for applying to the Second Chance Act involves several phases:
Verification of compliance with requirements: It is essential to ensure all legal requirements are met to initiate the process.
Creation of the file: All documentation proving the insolvency situation must be gathered.
Submission of the file to the court: A request is made to cancel the debts before the competent judge.
Debt cancellation: The judge issues an exoneration order, which is the document accrediting the forgiveness of debts.
Benefits of the Second Chance Act
Applying for the Second Chance Act offers multiple benefits:
Partial or total cancellation of outstanding debt: Unlike refinancing, here the total debt is reduced.
Removal of the debtor from delinquency records.
Cessation of harassment calls and collection letters from creditors.
Suspension of all interest on overdue debts.
Interruption of all present and future seizures.
Legal protection from the first moment.
Alternatives to the Second Chance Act
If the requirements to apply for the Second Chance Act are not met, there are other options for managing debts with the Tax Agency:
Debt deferral or installment: The Tax Agency allows debts of up to 50,000 euros to be deferred without guarantees, with a repayment term of 24 months.
Direct negotiation with the Tax Agency: In some cases, it is possible to negotiate directly with the Tax Agency to establish a payment plan that matches the debtor’s financial capacity.
In conclusion, the Second Chance Act is a valuable tool for those in an insolvency situation and needing a solution for their debts with the Tax Agency. By meeting the established requirements, it is possible to cancel a significant part of these debts and begin anew with a healthier financial situation. ✨
